Marylee counsels Fortune 500 companies, international businesses, and emerging technologies regarding intellectual property litigation and strategies, portfolio enforcement and management, and technology development, licensing, and protection. Her depth of knowledge and expertise in intellectual property law enables her to counsel clients from numerous industries on patent, trademark, and copyright matters. She has spent her entire career with an eye toward the future, working with government and legal organizations to improve existing laws and shape new ones as technology continues to change rapidly. Her leadership in the law is buttressed by her commitment to her clients representing a wide variety of industries including software and computer systems, consumer products and fashion design, information and financial services, biotech and medical devices, food and beverage, and real estate and construction.

Marylee has previously served as the Chairperson of the U.S. Patent and Trademark Office’s (USPTO) Patent Public Advisory Committee (PPAC) from 2016 to 2019 and was a member of PPAC from 2013 to 2019. PPAC reviews the policies, goals, performance, and budget of the USPTO’s patent operations and advises the Director of the USPTO on these matters.

Marylee has extensive experience in all aspects of domain name disputes, strategy and management, keyword, pop-up advertising, search engine, auction site and phishing matters; Internet and computer-related patent, trademark and copyright applications; intellectual property litigation focusing on disputes involving computers and the Internet; Internet, e-commerce and computer agreements concerning software development, telecommunication, computer and web systems and domain name portals; intellectual property licensing and co-branding; Internet strategies, studies and opinion work involving computer-related technology and consumer products and services businesses.

With respect to intellectual property protection and enforcement in general, Marylee has prosecuted numerous domestic and foreign patent applications in the electrical, electromechanical and computer-related areas, including computer hardware and software, Internet and computer-related technologies, telecommunication, information and financial systems, cameras, video camera recorders, optical and vision systems, heating systems and apparatuses, automobiles, electronic article surveillance systems and devices and electrical/mechanical systems and designs; has provided client counseling and opinion work concerning trademark selection, clearance, prosecution, registration, brand management and enforcement; has represented and advised clients in intellectual property and bankruptcy litigations involving technologies directed to electronics, consumer products and services, manufacturing, computer systems and the Internet and medical devices and in patent appeals, reexaminations, reissues and interferences and trademark oppositions before the US Patent and Trademark Office; and has developed and manages intellectual property portfolios for technology and consumer products and services businesses.

Professional Activities

Marylee was a member of John Marshall Law School’s Intellectual Property Law Advisory Board and was a member of Columbia Engineering School’s Engineering Council. Marylee was a member of the Committee on Internet Searching and the Domain Name System of the National Academy of Sciences’ Computer Science and Telecommunications Board that published the “Signposts in Cyberspace: The Domain Name System and Internet Navigation” report.

Marylee is involved in a variety of professional associations and organizations. She is an active member of the American Bar Association and is Past Chairperson of its Section of Intellectual Property Law. She has previously served as a member of the Section’s council and has also been the Section’s assistant to the secretary, Division VII chairperson as well as chairperson and liaison to several different Section committees and ABA entities. Marylee was appointed the ABA representative to the Intellectual Property Constituency of the Internet Corporation for Assigned Names and Numbers (ICANN) for six years by the ABA Board of Governors. She is currently serving again as a member of the ABA Standing Committee on Technology and Information Systems, is a fellow of the American Bar Foundation, and was recently appointed to the Appointed Standing Committees of the American Intellectual Property Law Association (AIPLA). Marylee has been a council member and director of the ABA Young Lawyers Division. She has been a member of the International Trademark Association’s Internet Committee as well as many other INTA committees over the past several years. Marylee is a past president of the New York Intellectual Property Law Association and was the Association’s treasurer and a member of its board of directors. She serves as a domain name panelist to the World Intellectual Property Organization Arbitration and Mediation Center.
