Partner Don McLean was a featured panelist in an American Agricultural Law Association webinar discussing pesticide regulation under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as well as the potential impacts of a major recent decision by the U.S. Court of Appeals for the Ninth Circuit.
Don presented alongside a former Assistant Administrator for EPA’s Office of Prevention, Pesticides, and Toxic Substances (now the Office of Chemical Safety and Pollution Prevention), the retired Assistant General Counsel for Pesticides at EPA, and an environmental litigator. Discussion centered on the requirements for registration of pesticides under FIFRA, the registrations of the herbicide dicamba for use on genetically engineered crops, and the potential impacts of the recent Ninth Circuit Court of Appeals decision in National Family Farm Coalition v. EPA that vacated those registrations.
