Aly Quoted on U.S. Supreme Court Ruling Affecting PTAB Director Authority
Intellectual Property Practice Group Co-Leader Imron Aly was quoted on the U.S. Supreme Court ruling in United States v. Arthrex, Inc. that the U.S. Patent and Trademark Office’s Patent Trial and Appeal Board (PTAB) administrative judges were unconstitutionally appointed, giving the PTAB Director authority to review their decisions.
Imron said that this ruling “doesn’t mean the director will actually review any [inter partes review] decision,” and that the director “as a practical matter would not want to insert themselves into individual cases very often.”
