Another One Bites the Dust: Court Tosses Nearly $350 Million False Claims Act Verdict Under Escobar

Arent Fox partners D. Jacques Smith and Randall Brater and associate Michael Dearington penned an article published in the April issue of Pratt’s Government Contracting Law Report on the recent reversal of a substantial False Claims Act verdict.

A federal district court in Florida vacated a $350 million FCA award based on the U.S. Supreme Court’s decision in U.S. ex rel. Escobar v. Universal Health Services, 136 S. Ct. 1989 (2016). The Arent Fox attorneys wrote:

“Together with the U.S. Court of Appeals for the Fifth Circuit’s recent decision in United States ex rel. Harman v. Trinity Industries Inc., this amounts to more than $1 billion in FCA verdicts tossed by courts over the last four months based on Escobar—an amount equal to more than a quarter of all FCA recoveries in FY 2017 combined.”
