Deeb Quoted on SCOTUS Ruling Covering the Waters of the U.S.
Partner Daniel Deeb was quoted on the U.S. Supreme Court decision that district courts have the jurisdiction over challenges to rules defining “waters of the United States.”
This decision means that a stay to the implementation of the 2015 Clean Water Rule previously issued by an appeals court will soon no longer be in effect.
Daniel said that interested parties will be looking for district courts in which to bring new challenges to the Clean Water Rule.
“After the Sixth Circuit stay is lifted, I think one of the first things you’ll see in one or more of the district court challenges is a request for a nationwide stay. We’ve seen it with the travel ban. District courts can do that. And I don’t know that this administration would resist a stay at all.”
