Loring Quoted on Legal Issues of Fast-Tracked EPA Review of Current Pollution Standards

Partner David Loring was quoted on potential legal challenges the U.S. Environmental Protection Agency (EPA) may face following an announcement that the agency will fast-track a review of current pollution standards for fine particulate matter, known as National Ambient Air Quality Standards (NAAQS), by reconvening a specialized panel to review new research.
David said that the EPA’s quick reconsideration of new research on fine particulate matter levels could face legal challenges both “procedurally and on substantive grounds.”
He added, because the EPA “intends to commission a new specialist panel to reconsider its prior 2019 Integrated Science Assessment rather than perform an entirely new assessment,” the agency could open itself up to challenges.
