Stephanie Trunk Quoted on PhRMA Drug Pricing Lawsuit in Bloomberg BNA

The Pharmaceutical Research and Manufacturers of America (PhRMA) filed a lawsuit against the state of California in response to the state’s new drug price law. 

The law, signed on October 9, states that drug makers must alert health care payers of a price increase with 60 days’ notice. In some cases, the law also requires drug makers to explain the increase as an improvement or change to the drug product.

PhRMA’s lawsuit claims that this law violates their first amendment rights and that announcing price increases in advance will create an anticompetitive market. Arent Fox Health Care partner Stephanie Trunk provided commentary on these developments in Bloomberg BNA’s Health Care Blog article, “New PhRMA Drug Pricing Lawsuit: We Have the Right to Remain Silent.” Stephanie noted, “This has kind of been touted as the model bill that was going to be rolled out in other states…So I think this is definitely the one to watch.” To read the article in full, click here.
