Washington Post Features Efforts of Arent Fox in District Nursing Home Case
Arent Fox, serving as class counsel along with co-counsel from the AARP Foundation Litigation and University Legal Services, will be arguing on behalf of thousands of DC-area nursing home residents in a case covered by The Washington Post.
The case is set to go to trial on September 13 before the US District Court for the District of Columbia.
Nursing home residents are asking the District in Brown, et al. v. District of Columbia to comply with long-standing federal law that allows individuals with disabilities to receive in-home care rather than live in state-run nursing homes.
The Post reported that, “Surveys consistently show that older people prefer to stay in their homes for as long as they can, and federal and local government policies have increasingly moved in that direction. A 1999 Supreme Court ruling said that public entities must provide community-based services to people with disabilities whenever possible and that unnecessarily institutionalizing them is a form of discrimination.”
“On behalf of our class members, who have waited nearly six years since this case was first filed, we are gratified that their claims against the District will be heard by the court,” said associate Brian Schneider. “The litigation team is excited to see the case come together for trial,” added associate Alison Andersen, “And we are looking forward to our clients having their voices heard.”
