AFS International’s Hunter Carter Co-Authors Chapter on Arbitration Awards in Colombia for Global Arbitration Review
ArentFox Schiff is pleased to announce that International Practice Co-Leader Hunter Carter has co-authored a chapter titled “Challenging and Enforcing Arbitration Awards: Colombia,” featured in the Global Arbitration Review’s (GAR) extensive online resource, Know-how.
The most important thing about an arbitral award is being able to enforce it, especially in a different country than where the award was rendered. In order to contribute to understanding how international arbitration awards are recognized and enforced in Colombia, Hunter, in collaboration with Colombian lawyer Diego Muñoz-Tamayo of Muñoz Tamayo & Asociados, examines the current state of evolving procedural and substantive requirements for challenging and enforcing arbitration awards in Colombia. Messrs. Carter and Muñoz Tamayo meticulously answer 58 questions regarding how to present awards for recognition and enforcement and how Colombian law and practice deal with a number of special circumstances, including timetables, grounds for setting aside an award, and the implementation of interim measures against assets in Colombia. The authors offer guidance for practitioners and other parties involved in arbitration proceedings with Colombian elements.
