Nelson Quoted on Bayh-Dole Act as a Potential Tool to Regulate Drug Pricing
Partner Kevin Nelson was quoted on the Knowledge Ecology International’s urging of the National Institutes of Health (NIH) to leverage the Bayh-Dole Act in order to combat rising drug prices.
In the event of a drug not meeting public health requirements, the Bayh-Dole Act gives the NIH the ability to take over a drug’s patent title, force the company to license the patent out to another company, or make the companies adjust the drug’s price.
Kevin said the Bayh-Dole tactic would be “valuable in small doses,” with the government possibly being able to get the prices down on certain drugs or at least for a certain group of people, such as KEI’s petitioning certain drugmakers to provide certain drugs to the U.S. Department of Veteran Affairs at cost.
