Consumer Products

A heightened regulatory environment for evaluating consumer complaints, along with “no-injury” class actions claiming misrepresentation on food and product labeling, are making the environment for consumer-product makers more challenging than ever.

Whether our clients are facing problems that have mass litigation potential or ones that are regulatory in nature, we help identify and mitigate the risks, recognizing that even a seemingly small or single claim can impact business relationships and increase litigation risk in significant and unforeseen ways.

We routinely work with companies to minimize the potential for litigation or regulatory actions. We assist clients with product-warning development and advise on document retention strategies. We also conduct confidential assessments in cases of troubling product failures. And we help companies avoid the legal pitfalls of new product documentation, counseling engineering and production teams on the front end to allow them to do their jobs without inadvertently creating documents that will allow the company to be portrayed unfairly in the press and in litigation down the road.

We also assist clients in reporting consumer complaints and other data to regulatory agencies, including the CPSC and NHTSA. We counsel clients on interactions with those agencies, and we help them establish best practices internally to ensure appropriate procedures are in place to handle advertising, product labeling and marketing; mandatory reporting; government enforcement proceedings; product quality and safety; and product recalls.

When a client faces litigation, our extensive experience in liability cases and class actions helps achieve favorable outcomes. We are adept at handling cases ranging from small claims to nationwide class actions, and we always scale our litigation approach to suit the type of claim and the potential risk. We also provide trial or case resolution options in nationwide jurisdictions.

We have been national coordinating and trial counsel for leading household and juvenile products manufacturers, and we have prevented litigation-driven recalls and copy-cat litigation in major class actions.
